Did you know women have up to three years to file equal pay lawsuits under the Equal Pay Act (EPA)?
The US Supreme Court decision in last year's Ledbetter case specified employees must file EEOC complaints within 300 days of suffering the discriminatory pay decision, but that only applies to sex discrimination cases brought under Title VII of the Civil Rights Act.
In fact, women have up to two years from the date of the last payment affected by sex-based wage discrimination to file a direct court action under the EPA and they never have to take the claim to the EEOC.
The EPA requires that men and women be given equal pay for equal work in the same establishment. The jobs need not be identical, but they must be substantially equal. And it's job content, not job titles that determine whether jobs are substantially equal.
