New ADA Compliance Traps That Snare Even Savvy HR Executives Training Seminar
Who'd have imagined that a company could lose an ADA lawsuit because it refused to allow a legally blind worker to operate a forklift? Or that a court could write an ADA ruling against a company that elected not to promote an employee who needed kidney dialysis 12 hours a day three days a week.
Both are recent cases where companies got stung for using what most of us would call common sense. The reason is that they didn't really understand the ADA and the obligations it places on employers. In the forklift case, would you have known that the courts expect you to have documented vision standards for driving forklifts? And that even if someone is legally blind, you can only deny the job after the person fails a vision test?
This conference will arm you with the tools you need to make the right decisions when complex ADA cases arise. At the end of this course, participants will be able to:
- Discuss the implications of several new ADA cases that reveal what the courts now expect from employers
- Explain the most current interpretation of "reasonable accommodation"
- List the most common mistakes companies make when confronted with ADA cases
- Recognize several "radioactive" job interview questions that expose your company to lawsuits
- Ask the most important question that interviewers need to ask all job candidates, not just those you think might be disabled
- Explain several easy, low-cost practices that companies can implement to reduce the risk of ADA lawsuits.
- Outline the basic provisions of the ADA.
