Most employers are well aware that the Americans with Disabilities Act requires them to make "reasonable accommodation" for the known physical or mental limitations of disabled employees or of otherwise qualified applicants.
Failure to comply with all of the reasonable accommodation requirements of the ADA can result in draconian penalties with significant financial consequences.
For example, both the EEOC and an individual can initiate a legal action that can result in back pay, reinstatement with full pay, injunctive relief, punitive damages, compensatory damages, and attorney's fees. Awards have been known to run into the many millions of dollars.
