There are very few cafeteria plans or group health plans (including health FSAs, HRAs, and fully insured group health plans) that would rate an A+ on compliance with the laws that apply to them, which may include the Code, ERISA, HIPAA, COBRA, and others.

  • What notices must every health plan issue (or be prepared to furnish)? What are thedeadlines? Are there any handy rules-of-thumb for how to furnish the notices?
  • Why is it especially important to make sure that a plan's contracts with its service providers are kept up to date? How can a plan make sure that its service providers are properly monitored?
  • How can you determine whether a plan has filed all required Form 5500s and whether the 5500s accuratelyreflected the plan's structure and operations?
