Summary Plan Descriptions for Health Plans (Including Health FSAs and HRAs)-How to Prepare and Deliver Effective SPDs Training Seminar
ERISA requires summary plan descriptions (SPDs) for all health plans, including health FSAs and HRAs, and the list of required contents is long. With plan participants relying on SPDs to resolve benefits issues, having an SPD that complies with ERISA's requirements can make the difference between winning and losing in court.
Join us for a 90-minute web seminar with our experts, who will walk you through a checklist of ERISA's SPD requirements and a step-by-step guide to drafting, reviewing, and revising SPDs.
Here's some of what we'll cover:- What must be included in a health plan's SPD? Are there different rules for health FSAs and HRAs? Can the SPD also serve as the plan document?
- Are any of the requirements different for fully insured plans? Do the certificates or benefits booklets provided by insurers satisfy the SPD requirements? What if an insurer is late in providing certificates or booklets?
- Should an employer rely on an insurer, TPA, or other service provider to be responsible for the SPD?
- What are the distribution requirements for SPDs? Is electronic distribution a realistic option? What are the deadlines for providing SPDs and how often do SPDs need to be updated?
- What happens if an SPD doesn't accurately reflect the terms of an insurance contract, stop-loss coverage, or self-funded plan, or otherwise does not comply with the ERISA rules?
- What are some of the SPD flaws that have shown up in recent cases and what were the consequences?
